Terms of Service

1. Service description

Pathvance is a multi-institution career development and examination management platform for international schools in Indonesia. The Service includes assessment delivery, scoring, longitudinal student profiles, career recommendations, PDF report generation, and administration tools for school staff.

2. Accounts and institution relationship

Each partner school is the customer ("Customer") under a separate subscription agreement and operates as an isolated institution on the platform. Students, parents, teachers, counselors, principals, and school administrators are end users provisioned by the Customer. End users may not self-register. The Customer is responsible for the accuracy of provisioned data and for obtaining all necessary consents from end users, including parents or guardians of minors.

3. Acceptable use

You agree not to:

• Use the Service in violation of any applicable law, including UU PDP.
• Attempt to access data belonging to an institution other than your own, or otherwise circumvent the institution isolation model.
• Reverse engineer, decompile, or attempt to extract the source code of the Service, except as permitted by law.
• Upload malware, attempt to disrupt the Service, or perform unauthorized security testing.
• Use the Service to harass, defame, or harm others, including students.
• Resell, sublicense, or commercially redistribute the Service or its content without written permission.

4. Intellectual property

The Service — including its software, design system, assessment items, scoring algorithms, documentation, and brand — is the exclusive property of Pathvance and its licensors. Customers retain ownership of their school content, student records, and assessment responses ("Customer Data"). Customers grant Pathvance a limited license to host, process, and display Customer Data solely to provide the Service.

5. Assessment results — not professional advice

Assessment results, career recommendations, and PDF reports generated by the Service are intended for self-exploration and educational guidance. They are not a substitute for professional psychological, medical, academic, or career counseling. Students and parents should discuss results with a qualified school counselor or other professional before making significant life decisions.

6. Data protection

Pathvance processes personal data in accordance with the Privacy Policy and any applicable Data Processing Agreement signed with the Customer. The Customer remains the data controller for end-user personal data; Pathvance acts as the data processor on the Customer's instructions, except where Pathvance acts as controller for security, audit, and platform integrity purposes.

7. Disclaimers and warranties

The Service is provided "as is" and "as available". To the maximum extent permitted by law, Pathvance disclaims all warranties not expressly granted in the subscription agreement, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

8. Limitation of liability

To the maximum extent permitted by law, Pathvance's aggregate liability arising out of or related to the Service shall not exceed the fees paid by the Customer to Pathvance in the twelve (12) months preceding the event giving rise to the claim. Pathvance is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, goodwill, or data, even if advised of the possibility.

9. Term and termination

These Terms remain in force for the duration of the Customer's subscription. Either party may terminate the subscription in accordance with the subscription agreement. On termination, Customer Data will be retained in accordance with Indonesian educational records retention requirements (see Privacy Policy section 8), after which it will be deleted or anonymized.

10. Changes to the Service

Pathvance may modify or discontinue features of the Service from time to time. Material changes that materially reduce functionality used by the Customer will be communicated in advance where reasonably practicable.

11. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Indonesia, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Jakarta, Indonesia, unless otherwise required by mandatory law.
